July 19, 2011

CALL TO ORDER/Pledge of Allegiance
Chairman Erland Torrey called the meeting to order at 6:00PM with Selectmen Larry Moreau, Lester Stevens and Steve Robinson present.  Selectman Sanborn arrived at 6:10pm. The Acting Town Manager and Recording Secretary were also present.  

EXECUTIVE SESSION
Selectman Moreau move that the Board of Selectmen enter into executive session with the Town Attorney, Acting Town Manager and Recording Secretary pursuant to Title 1 MRSA Chapter 13 Public Records and Proceedings, § 405 Executive Sessions, § 6 (C) to discuss the consideration of property use or acquisition.  Selectman Stevens seconded the motion.  Discussion:  None.
Vote:  4-yes 0-no  

No Action Taken.

MINUTES OF PREVIOUS MEETING
Selectman Moreau moved to bring the minutes of June 21, 2011 to the table for discussion. Selectmen Sanborn seconded the motion.  Discussion:  There is an error noted in the motion regarding the appointment of the Code Enforcement Officer.

Selectman Moreau moved to table the June 21, 2011 minutes for corrections.  Selectman Robinson seconded the motion.  Discussion:  None.

Selectman Moreau moved to approve the meeting minutes of June 27, 2011 as presented. Selectman Sanborn seconded the motion.  Discussion:  None.

RSU #16 Assessment of Unit Tax (taken out of order)
Town attorney, Natalie Burns, stated to the Board that the RSU statutes are clearly defined that there is no allowable discretion as to the amount the town may commit.  The amount submitted to the Board on the school assessment must be the amount committed.   It was also discussed that monthly payments must be paid within 60 days.  If payment is not received after the 60 days the RSU can file a complaint in superior court in which measures will be taken to see that the town pays the bill.

Crack Sealing Bid
Selectman Moreau moved to table the crack sealing bid until further information can be provided. Selectman Sanborn seconded the motion.  Discussion:  The Board would like to have all quotes submitted in linear feet.

Annual Paving Bid
Selectman Moreau moved to award RC & Sons Paving the annual paving bid in the amount of $241,357.60 as presented.  Selectman Sanborn seconded the motion.  Discussion:  None.

APPOINTMENTS
Selectman Moreau moved to appoint William Foster to the Planning Board as an alternate member for a term of three (3) years.  Selectman Stevens seconded the motion.  Discussion:  None.

Recognition of Visitors (A list of visitors who attended the meeting are attached to these minutes.)  Stan Tetenman discussed with the Board their position on becoming the trustees of the Jane Ricker Memorial Trust fund.  Don Stover expressed his opinion on the Board’s decision not to have a Town Forester.

So. Village Project
Ground Lease & Easement Deeds - Once all of the easements are signed they will be brought back to the Board for acceptance.  Selectman Moreau moved to approve the document language as presented by John Cleveland.  Selectman Sanborn seconded the motion.  Discussion:  None.

Agreement Authorization/Image Inc. - Selectman Moreau moved to authorize the Acting Town Manager to enter into an agreement with Image, Inc on behalf of the Town that outlines the commitments~that have been made~regarding the use of the property~for the South Village water project.  Selectman Sanborn seconded the motion.  Discussion:  None.

Auburn Water & Sewer Agreements – First review.

Summit Environmental Agreement - Selectman Moreau moved to authorize the Acting Town Manager to enter into an agreement with Summit Environmental Consultants for the purpose of testing critical areas for quality assurance for the South Village project.  Selectman Sanborn seconded the motion.  Discussion:  None
Vote: 5-Yes 0-No

Payments of Monthly Invoices - Selectman Sanborn moved to authorize the Acting Town Manager to review and approve the payment of monthly invoices on the South Village Water and Sewer project.  Selectman Moreau seconded the motion.  Discussion:  It was confirmed that the invoices will still go through the payables process.

Ricker Memorial Library Trust – Asset Manager
The draft RFP will go out in 2 days to the Selectmen and the Library Trustees and the manager would like to have any comments returned as soon as possible.

New Business
MMA – Annual Elections
Selectman Moreau moved to vote the Maine Municipal Association ballot as presented.  Selectman Sanborn seconded the motion.  Discussion:  none.
Vote:  5-yes 0-no

Payables
Selectman Moreau moved to approve the bills payable for the FYE 2011 in the amount of $29,297.33.  Selectman Sanborn seconded the motion.  Discussion:  None.
Vote:  5-yes 0-no

Selectman Moreau moved to approve the FYE 2012 bills payable in the amount of $580,749.75.  Selectman Robinson seconded the motion.  Discussion:  The Board agreed to not to pay the RSU July invoice for a period of 60 days.  Selectmen Moreau moved to approve the FYE 2012 bills payable for the amended amount of $88,435.45 which specifically excludes the RSU invoice.  Selectman Robinson seconded the motion.  
Vote:  5-yes 0-no

Any Other Business
Selectman Moreau moved to authorize the manager to execute the Solid Waste Landfill Closure Affidavit.  Selectman Sanborn seconded the motion.  Discussion:  None.
